Renting space, not leaving your car in custody

  • This Agreement rents parking space. The Owner does not take custody of the Vehicles or their keys (Clause 2.3). In Thai law, a person who takes custody of property for a fee must look after it with the care of a reasonable person in that business; that heavier duty does not apply here. If the Renter wants valet parking or key-holding, that is a different, custodial service with a different price and a different risk.
  • The Owner is still liable for its own negligence and for dangerous defects in the Car Park (Clause 7.1). A term that excludes liability for negligence causing death or injury is void, and a clause that excludes all liability for damage to property may be cut down by a court if it is unfair.
  • The Car Park is self-service. Check the Renter's car insurance for theft and damage while parked.- The Owner has promised the security service in Clause 6.2. If a Vehicle is damaged or stolen, report it before leaving the Car Park and ask at once for the recordings to be kept (Clause 7.3).

Stamp duty

Practical points

  • Register every vehicle and replacement vehicle with the Owner (Clause 3.2), especially if the Car Park uses licence-plate recognition.
  • Charge only at approved chargers (Clause 4). Charging from an ordinary socket is a common cause of car park fires.
  • The Owner must not clamp or tow a Vehicle to force payment. After the Agreement ends, the Owner may move a Vehicle only after at least 14 days' notice and only as the law permits (Clause 9.4).
  • Licence-plate numbers and camera images are personal data. The Owner must give a privacy notice and keep recordings secure (Clause 8).

Signing and evidence

  • Keep the signed Agreement, the Car Park Rules, receipts and the list of registered vehicles.
  • A Thai court works in Thai. A Party that relies on this Agreement in court must file a certified Thai translation.

พระราชบัญญัตินี้ไม่ใช้บังคับแก่ (1) การเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของบุคคลที่ทำการเก็บรวบรวมข้อมูล ส่วนบุคคลเพื่อประโยชน์ส่วนตนหรือเพื่อกิจกรรมในครอบครัวของบุคคลนั้นเท่านั้น (2) การดำเนินการของหน่วยงานของรัฐที่มีหน้าที่ในการรักษาความมั่นคงของรัฐ ซึ่งรวมถึง ความมั่นคงทางการคลังของรัฐ หรือการรักษาความปลอดภัยของประชาชน รวมทั้งหน้าที่เกี่ยวกับ การป้องกันและปราบปรามการฟอกเงิน นิติวิทยาศาสตร์ หรือการรักษาความมั่นคงปลอดภัยไซเบอร์ (3) บุคคลหรือนิติบุคคลซึ่งใช้หรือเปิดเผยข้อมูลส่วนบุคคลที่ทำการเก็บรวบรวมไว้เฉพาะ เพื่อกิจการสื่อมวลชน งานศิลปกรรม หรืองานวรรณกรรมอันเป็นไปตามจริยธรรมแห่งการประกอบวิชาชีพ หรือเป็นประโยชน์สาธารณะเท่านั้น (4) สภาผู้แทนราษฎร วุฒิสภา และรัฐสภา รวมถึงคณะกรรมาธิการที่แต่งตั้งโดยสภาดังกล่าว ซึ่งเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลในการพิจารณาตามหน้าที่และอำนาจของสภาผู้แทนราษฎร วุฒิสภา รัฐสภา หรือคณะกรรมาธิการ แล้วแต่กรณี (5) การพิจารณาพิพากษาคดีของศาลและการดำเนินงานของเจ้าหน้าที่ในกระบวนการพิจารณาคดี การบังคับคดี และการวางทรัพย์ รวมทั้งการดำเนินงานตามกระบวนการยุติธรรมทางอาญา (6) การดำเนินการกับข้อมูลของบริษัทข้อมูลเครดิตและสมาชิกตามกฎหมายว่าด้วย การประกอบธุรกิจข้อมูลเครดิต การยกเว้นไม่ให้นำบทบัญญัติแห่งพระราชบัญญัตินี้ทั้งหมดหรือแต่บางส่วนมาใช้บังคับแก่ ผู้ควบคุมข้อมูลส่วนบุคคลในลักษณะใด กิจการใด หรือหน่วยงานใดทำนองเดียวกับผู้ควบคุมข้อมูล ส่วนบุคคลตามวรรคหนึ่ง หรือเพื่อประโยชน์สาธารณะอื่นใด ให้ตราเป็นพระราชกฤษฎีกา ผู้ควบคุมข้อมูลส่วนบุคคลตามวรรคหนึ่ง (2) (3) (4) (5) และ (6) และผู้ควบคุมข้อมูล ส่วนบุคคลของหน่วยงานที่ได้รับยกเว้นตามที่กำหนดในพระราชกฤษฎีกาตามวรรคสอง ต้องจัดให้มี การรักษาความมั่นคงปลอดภัยของข้อมูลส่วนบุคคลให้เป็นไปตามมาตรฐานด้วย

ในการเก็บรวบรวมข้อมูลส่วนบุคคล ผู้ควบคุมข้อมูลส่วนบุคคลจะต้องแจ้ง ให้เจ้าของข้อมูลส่วนบุคคลทราบก่อนหรือในขณะเก็บรวบรวมข้อมูลส่วนบุคคลถึงรายละเอียด ดังต่อไปนี้ เว้นแต่เจ้าของข้อมูลส่วนบุคคลได้ทราบถึงรายละเอียดนั้นอยู่แล้ว (1) วัตถุประสงค์ของการเก็บรวบรวมเพื่อการนำข้อมูลส่วนบุคคลไปใช้หรือเปิดเผยซึ่งรวมถึง วัตถุประสงค์ตามที่มาตรา 24 ให้อำนาจในการเก็บรวบรวมได้โดยไม่ได้รับความยินยอมจากเจ้าของ ข้อมูลส่วนบุคคล (2) แจ้งให้ทราบถึงกรณีที่เจ้าของข้อมูลส่วนบุคคลต้องให้ข้อมูลส่วนบุคคลเพื่อปฏิบัติ ตามกฎหมายหรือสัญญาหรือมีความจำเป็นต้องให้ข้อมูลส่วนบุคคลเพื่อเข้าทำสัญญา รวมทั้งแจ้งถึง ผลกระทบที่เป็นไปได้จากการไม่ให้ข้อมูลส่วนบุคคล (3) ข้อมูลส่วนบุคคลที่จะมีการเก็บรวบรวมและระยะเวลาในการเก็บรวบรวมไว้ ทั้งนี้ ในกรณี ที่ไม่สามารถกำหนดระยะเวลาดังกล่าวได้ชัดเจน ให้กำหนดระยะเวลาที่อาจคาดหมายได้ตามมาตรฐาน ของการเก็บรวบรวม (4) ประเภทของบุคคลหรือหน่วยงานซึ่งข้อมูลส่วนบุคคลที่เก็บรวบรวมอาจจะถูกเปิดเผย (5) ข้อมูลเกี่ยวกับผู้ควบคุมข้อมูลส่วนบุคคล สถานที่ติดต่อ และวิธีการติดต่อในกรณี ที่มีตัวแทนหรือเจ้าหน้าที่คุ้มครองข้อมูลส่วนบุคคล ให้แจ้งข้อมูล สถานที่ติดต่อ และวิธีการติดต่อของ ตัวแทนหรือเจ้าหน้าที่คุ้มครองข้อมูลส่วนบุคคลด้วย (6) สิทธิของเจ้าของข้อมูลส่วนบุคคลตามมาตรา 19 วรรคห้า มาตรา 30 วรรคหนึ่ง

ห้ามมิให้ผู้ควบคุมข้อมูลส่วนบุคคลทำการเก็บรวบรวมข้อมูลส่วนบุคคลจาก แหล่งอื่นที่ไม่ใช่จากเจ้าของข้อมูลส่วนบุคคลโดยตรง เว้นแต่ (1) ได้แจ้งถึงการเก็บรวบรวมข้อมูลส่วนบุคคลจากแหล่งอื่นให้แก่เจ้าของข้อมูลส่วนบุคคลทราบ โดยไม่ชักช้า แต่ต้องไม่เกินสามสิบวันนับแต่วันที่เก็บรวบรวมและได้รับความยินยอมจากเจ้าของข้อมูล ส่วนบุคคล (2) เป็นการเก็บรวบรวมข้อมูลส่วนบุคคลที่ได้รับยกเว้นไม่ต้องขอความยินยอมตามมาตรา 24 หรือมาตรา 26 ให้นำบทบัญญัติเกี่ยวกับการแจ้งวัตถุประสงค์ใหม่ตามมาตรา 21 และการแจ้งรายละเอียด ตามมาตรา 23 มาใช้บังคับกับการเก็บรวบรวมข้อมูลส่วนบุคคลที่ต้องได้รับความยินยอมตามวรรคหนึ่ง โดยอนุโลม เว้นแต่กรณีดังต่อไปนี้ (1) เจ้าของข้อมูลส่วนบุคคลทราบวัตถุประสงค์ใหม่หรือรายละเอียดนั้นอยู่แล้ว (2) ผู้ควบคุมข้อมูลส่วนบุคคลพิสูจน์ได้ว่าการแจ้งวัตถุประสงค์ใหม่หรือรายละเอียดดังกล่าว ไม่สามารถทำได้หรือจะเป็นอุปสรรคต่อการใช้หรือเปิดเผยข้อมูลส่วนบุคคล โดยเฉพาะอย่างยิ่งเพื่อให้ บรรลุวัตถุประสงค์เกี่ยวกับการศึกษาวิจัยทางวิทยาศาสตร์ ประวัติศาสตร์ หรือสถิติ ในกรณีนี้ผู้ควบคุม ข้อมูลส่วนบุคคลต้องจัดให้มีมาตรการที่เหมาะสมเพื่อคุ้มครองสิทธิ เสรีภาพ และประโยชน์ของเจ้าของ ข้อมูลส่วนบุคคล (3) การใช้หรือการเปิดเผยข้อมูลส่วนบุคคลต้องกระทำโดยเร่งด่วนตามที่กฎหมายกำหนด ซึ่งได้จัดให้มีมาตรการที่เหมาะสมเพื่อคุ้มครองประโยชน์ของเจ้าของข้อมูลส่วนบุคคล (4) เมื่อผู้ควบคุมข้อมูลส่วนบุคคลเป็นผู้ซึ่งล่วงรู้หรือได้มาซึ่งข้อมูลส่วนบุคคลจากหน้าที่ หรือจากการประกอบอาชีพหรือวิชาชีพและต้องรักษาวัตถุประสงค์ใหม่หรือรายละเอียดบางประการ ตามมาตรา 23 ไว้เป็นความลับตามที่กฎหมายกำหนด การแจ้งรายละเอียดตามวรรคสอง ผู้ควบคุมข้อมูลส่วนบุคคลต้องแจ้งให้เจ้าของข้อมูล ส่วนบุคคลทราบภายในสามสิบวันนับแต่วันที่เก็บรวบรวมตามมาตรานี้ เว้นแต่กรณีที่นำข้อมูลส่วนบุคคล ไปใช้เพื่อการติดต่อกับเจ้าของข้อมูลส่วนบุคคลต้องแจ้งในการติดต่อครั้งแรก และกรณีที่จะนำข้อมูล ส่วนบุคคลไปเปิดเผย ต้องแจ้งก่อนที่จะนำข้อมูลส่วนบุคคลไปเปิดเผยเป็นครั้งแรก
