At pick-up

  • Check each driver's passport and driving licence against Schedule 1. A foreign driver normally needs a licence from their home country together with an International Driving Permit, or a Thai driving licence. Take copies, and delete them when they are no longer needed (Clause 13).
  • Walk around the car together. Photograph and film every panel, the wheels, the windscreen, the interior, the fuel gauge and the odometer, and send the files to the other side before the car leaves (Clause 3.2). Fill in the pick-up column of the Condition Report.
  • Check that the car carries a copy of the registration book, the compulsory insurance sticker or certificate, the voluntary insurance details and the insurer's hotline number, a spare tyre and a jack.
  • Never hand over or accept a passport as security. The deposit in Clause 6.3 is the security.

Stamp duty

  • No stamp duty is payable on this Agreement. Only leases of land, buildings, other structures and floating houses are listed in the Stamp Duty Schedule of the Revenue Code (Instrument 1). A car is movable property, so its rental agreement is not a dutiable instrument.

VAT and withholding tax

Agree in advance whether the Rental is quoted before or after this withholding. A tourist renting in their own name does not withhold.

During the rental

  • Keep the Lessor's 24-hour number and the insurer's hotline in your phone.
  • In an accident: make the scene safe, call the police (191) and, if needed, an ambulance (1669), call the insurer's hotline and the Lessor, and take photos. Do not agree a cash settlement with the other driver or sign anything you cannot read (Clause 8.5). If someone is injured, the compulsory motor insurance covers initial medical costs.
  • Drink-driving, letting someone else drive, carrying passengers for payment or leaving Thailand removes the protection of the excess (Clause 8.4) and may also be a criminal offence or void the insurance.
  • To extend the rental, agree it in writing (a message is enough) before the End Time and pay the extra days in advance (Clauses 6.2 and 16.2).

At return

  • Return the car with at least the same fuel or battery level, and keep the fuel receipt (Clause 7.1).
  • Inspect the car together, fill in the return column of the Condition Report and take new photos and a video, including the fuel gauge and the odometer (Clause 3.3). If you return the car out of hours, film it at the return place and send the files to the Lessor straight away.
  • The Lessor may charge for damage found later only if it tells you in writing, with photographs, within 24 hours after the return (Clause 3.4).

The deposit, fines and tolls

  • The Lessor must return the deposit within the number of days in Clause 11.1, with a written statement and evidence for every deduction, such as a repair invoice or the insurer's excess invoice.
  • Speed-camera fines and expressway toll notices often reach the Lessor weeks after the rental. The Lessor sends each one with a copy of the notice, and the Lessee pays only the actual amount, with no administration fee (Clause 7.2).

Evidence to keep

  • The signed Agreement and Schedule 1, with both Condition Reports.
  • All photos and videos with their original date and time, and the messages or emails used to send them.
  • Payment slips or card receipts, the fuel receipt at return, and any police or insurance report.

If a dispute goes to a Thai court

  • A Lessor may claim against the Lessee for damage to the car within 6 months after the car is returned (Civil and Commercial Code section 563). Keep your evidence at least that long.
  • A Thai court works in Thai. A party who relies on this Agreement or English messages in court must file a certified Thai translation. Most rental disputes are settled once the photos from both inspections are compared, so exchange them before starting any claim.

ในหมวดนี้ เว้นแต่ข้อความจะแสดงให้เห็นเป็นอย่างอื่น (1) “บุคคล” หมายความว่า บุคคลธรรมดา คณะบุคคลที่มิใช่นิติบุคคล หรือนิติบุคคล (2) “บุคคลธรรมดา” หมายความรวมถึง กองมรดก (3) “คณะบุคคลที่มิใช่นิติบุคคล” หมายความว่า ห้างหุ้นส่วนสามัญ กองทุน หรือมูลนิธิที่มิใช่นิติบุคคล และให้หมายความรวมถึงหน่วยงาน หรือกิจการของเอกชนที่กระทำโดยบุคคลธรรมดาตั้งแต่สองคนขึ้นไปอันมิใช่นิติบุคคล (4) “นิติบุคคล” หมายความว่า บริษัทหรือห้างหุ้นส่วนนิติบุคคลตามมาตรา 39 องค์การของรัฐบาลตามมาตรา 2 สหกรณ์ และองค์กรอื่นที่กฎหมายกำหนดให้เป็นนิติบุคคล (5) “ผู้ประกอบการ” หมายความว่า บุคคลซึ่งขายสินค้าหรือให้บริการในทางธุรกิจหรือวิชาชีพไม่ว่าการกระทำดังกล่าวจะได้รับประโยชน์หรือได้รับค่าตอบแทนหรือไม่ และไม่ว่าจะได้จดทะเบียนภาษีมูลค่าเพิ่มแล้วหรือไม่ (6) “ผู้ประกอบการจดทะเบียน” หมายความว่า ผู้ประกอบการที่ได้จดทะเบียนภาษีมูลค่าเพิ่ม ตามมาตรา 85 หรือมาตรา 85/1 หรือที่ได้จดทะเบียนภาษีมูลค่าเพิ่มชั่วคราวตามมาตรา 85/3 (7) “ตัวแทน” หมายความรวมถึงบุคคลซึ่งทำสัญญาหรือมีหน้าที่รับผิดชอบในการเก็บรักษาสินค้า หาลูกค้า หรือทำการใด ๆ อันเกี่ยวกับการประกอบกิจการในราชอาณาจักรแทนผู้ประกอบการที่อยู่นอกราชอาณาจักร (8) “ขาย” หมายความว่า จำหน่าย จ่าย โอนสินค้าไม่ว่าจะมีประโยชน์หรือค่าตอบแทนหรือไม่ และให้หมายความรวมถึง (ก) สัญญาให้เช่าซื้อสินค้า สัญญาซื้อขายผ่อนชำระที่กรรมสิทธิ์ในสินค้ายังไม่โอนไปยังผู้ซื้อเมื่อได้ส่งมอบสินค้าให้ผู้ซื้อแล้ว หรือสัญญาจะขายสินค้าที่เป็นไปตามหลักเกณฑ์ และเงื่อนไขที่อธิบดีกำหนดโดยอนุมัติรัฐมนตรี (ข) ส่งมอบสินค้าให้ตัวแทนเพื่อขาย (ค) ส่งสินค้าออกนอกราชอาณาจักร (ง) นำสินค้าไปใช้ไม่ว่าประการใด ๆ เว้นแต่การนำสินค้าไปใช้เพื่อการประกอบกิจการของตนเองโดยตรงตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่อธิบดีกำหนด (จ) มีสินค้าขาดจากรายงานสินค้าและวัตถุดิบตามมาตรา 87 (3) หรือมาตรา 87 วรรคสอง (ฉ) มีสินค้าคงเหลือและหรือทรัพย์สินที่ผู้ประกอบการมีไว้ในการประกอบกิจการ ณ วันเลิกประกอบกิจการ แต่ไม่รวมถึงสินค้าคงเหลือและหรือทรัพย์สินดังกล่าวของผู้ประกอบการซึ่งได้ควบเข้ากันหรือได้โอนกิจการทั้งหมดให้แก่กัน ทั้งนี้ ผู้ประกอบการใหม่อันได้ควบเข้ากันหรือผู้รับโอนกิจการต้องอยู่ในบังคับที่ต้องเสียภาษีมูลค่าเพิ่มตามมาตรา 82/3 (ช) กรณีอื่นตามที่กำหนดในกฎกระทรวง (9) “สินค้า” หมายความว่า ทรัพย์สินที่มีรูปร่างและไม่มีรูปร่างที่อาจมีราคาและถือเอาได้ ไม่ว่าจะมีไว้เพื่อขาย เพื่อใช้ หรือเพื่อการใด ๆ และให้หมายความรวมถึงสิ่งของทุกชนิดที่นำเข้า แต่ทั้งนี้ไม่รวมถึงทรัพย์สินที่ไม่มีรูปร่างที่ส่งมอบโดยผ่านทางเครือข่ายอินเทอร์เน็ตหรือเครือข่ายทางอิเล็กทรอนิกส์อื่นใด (10) “บริการ” หมายความว่า การกระทำใด ๆ อันอาจหาประโยชน์อันมีมูลค่าซึ่งมิใช่เป็นการขายสินค้า และให้หมายความรวมถึงการใช้บริการของตนเองไม่ว่าประการใด ๆ แต่ทั้งนี้ไม่รวมถึง (ก) การใช้บริการหรือการนำสินค้าไปใช้เพื่อประกอบกิจการของตนเองโดยตรงตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่อธิบดีกำหนด (ข) การนำเงินไปหาประโยชน์โดยการฝากธนาคารหรือซื้อพันธบัตรหรือหลักทรัพย์ (ค) การกระทำตามที่อธิบดีกำหนดโดยอนุมัติรัฐมนตรี (10/1) “บริการทางอิเล็กทรอนิกส์” หมายความว่า บริการซึ่งรวมถึงทรัพย์สินที่ไม่มีรูปร่างที่ส่งมอบโดยผ่านทางเครือข่ายอินเทอร์เน็ตหรือเครือข่ายทางอิเล็กทรอนิกส์อื่นใด ซึ่งลักษณะของบริการเป็นไปโดยอัตโนมัติในสาระสำคัญ โดยบริการดังกล่าวไม่สามารถกระทำได้หากปราศจากเทคโนโลยีสารสนเทศ (10/2) “อิเล็กทรอนิกส์แพลตฟอร์ม” หมายความว่า ตลาด ช่องทาง หรือกระบวนการอื่นใดที่ผู้ให้บริการหลายรายใช้ในการให้บริการทางอิเล็กทรอนิกส์แก่ผู้รับบริการ

ประมวลรัษฎากร มาตรา 80

ให้ใช้อัตราภาษีร้อยละ 10.0 ในการคำนวณภาษีมูลค่าเพิ่มสำหรับการประอบกิจการดังต่อไปนี้ ทั้งนี้ เว้นแต่กรณีที่กำหนดไว้ในมาตรา 80/2 (1) การขายสินค้า (2) การให้บริการ (3) การนำเข้าอัตราภาษีตามวรรคหนึ่งให้ลดลงได้โดยตราเป็นพระราชกฤษฎีกา แต่ต้องกำหนดอัตราภาษีให้เป็นอัตราภาษีเดียวกันสำหรับการขายสินค้า การให้บริการ และการนำเข้าทุกกรณี

พ.ร.บ.คุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 มาตรา 24

ห้ามมิให้ผู้ควบคุมข้อมูลส่วนบุคคลทำการเก็บรวบรวมข้อมูลส่วนบุคคล โดยไม่ได้รับความยินยอมจากเจ้าของข้อมูลส่วนบุคคล เว้นแต่ (1) เพื่อให้บรรลุวัตถุประสงค์ที่เกี่ยวกับการจัดทำเอกสารประวัติศาสตร์หรือจดหมายเหตุ เพื่อประโยชน์สาธารณะ หรือที่เกี่ยวกับการศึกษาวิจัยหรือสถิติซึ่งได้จัดให้มีมาตรการปกป้องที่เหมาะสม เพื่อคุ้มครองสิทธิและเสรีภาพของเจ้าของข้อมูลส่วนบุคคล ทั้งนี้ ตามที่คณะกรรมการประกาศกำหนด (2) เพื่อป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของบุคคล (3) เป็นการจำเป็นเพื่อการปฏิบัติตามสัญญาซึ่งเจ้าของข้อมูลส่วนบุคคลเป็นคู่สัญญาหรือ เพื่อใช้ในการดำเนินการตามคำขอของเจ้าของข้อมูลส่วนบุคคลก่อนเข้าทำสัญญานั้น (4) เป็นการจำเป็นเพื่อการปฏิบัติหน้าที่ในการดำเนินภารกิจเพื่อประโยชน์สาธารณะของผู้ควบคุม ข้อมูลส่วนบุคคล หรือปฏิบัติหน้าที่ในการใช้อำนาจรัฐที่ได้มอบให้แก่ผู้ควบคุมข้อมูลส่วนบุคคล (5) เป็นการจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมายของผู้ควบคุมข้อมูลส่วนบุคคล หรือของบุคคลหรือนิติบุคคลอื่นที่ไม่ใช่ผู้ควบคุมข้อมูลส่วนบุคคล เว้นแต่ประโยชน์ดังกล่าวมีความสำคัญ น้อยกว่าสิทธิขั้นพื้นฐานในข้อมูลส่วนบุคคลของเจ้าของข้อมูลส่วนบุคคล (6) เป็นการปฏิบัติตามกฎหมายของผู้ควบคุมข้อมูลส่วนบุคคล
