  • If the Producer or the Client is abroad, different withholding rules and double tax treaties may apply. Ask an accountant before the first payment.

Before the shoot

  • Approve the Locked Script in writing (Clause 3.2). After that, changes to the script, cast, locations or number of days are Change Orders with a price (Clause 4).
  • Ask the Producer for copies of the signed Performer consents and the list of Cleared Materials with their periods and media (Clause 6.3). Put the end of the Usage period in your calendar: using the video after it, or in new media, requires new rights.
  • For a performer under 20, a parent or legal guardian must also sign. If a child is paid to perform, check the child-labour rules on age, working hours and night work before the shoot.
  • Filming in public places, on roads, in parks and with drones needs permits. A foreign crew filming in Thailand may need permission from the Thailand Film Office and work permits for its members; check this early because approvals take time.
  • For filming in someone's home, shop or office, sign a location agreement with the owner and, for a rented property or condominium, get the landlord's or building management's consent.

Synthetic media

  • Clause 11 prohibits digital replicas, synthetic voices and deepfakes of real people without their specific written consent. Many platforms also require AI-generated or altered content to be labelled; the Producer must tell the Client which elements were generated (Clause 11.2).

Ownership and files

  • Copyright in the Final Video passes to the Client when the Fee and approved Change Orders are paid in full (Clause 10.1). Keep the final transfer slip with the signed Agreement as proof.- The Producer keeps copyright and the Client has a permanent exclusive licence once paid (Clause 10.1). Without that clause, Thai law would give copyright in a commissioned video to the Client, so keep the signed Agreement safely.
  • A transfer or licence of copyright must be in writing and signed by both Parties.
  • The raw Footage stays with the Producer for 12 months (Clause 10.3). Ask for any extra edits or copies within that time.- The raw Footage and project files are delivered with the Deliverables (Clause 10.3). Back them up at once; they contain personal data of the people filmed and must be stored securely.

Payment and evidence

  • Instalment 2 is due before the first shooting day (Clause 8.2). If it is late, the Producer may postpone the shoot after notice (Clause 8.5), and the Client may have to pay costs for crew already booked.
  • Keep the signed PDF, the Locked Script, every Change Order, the review comments, invoices, transfer slips and withholding tax certificates.
  • A Thai court works in Thai, so English documents need a certified Thai translation in a dispute. If the other Party has no assets in Thailand, staged payments protect both sides better than a lawsuit.

ผู้ควบคุมข้อมูลส่วนบุคคลจะกระทำการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูล ส่วนบุคคลไม่ได้หากเจ้าของข้อมูลส่วนบุคคลไม่ได้ให้ความยินยอมไว้ก่อนหรือในขณะนั้น เว้นแต่บทบัญญัติ แห่งพระราชบัญญัตินี้หรือกฎหมายอื่นบัญญัติให้กระทำได้ การขอความยินยอมต้องทำโดยชัดแจ้ง เป็นหนังสือหรือทำโดยผ่านระบบอิเล็กทรอนิกส์ เว้นแต่ โดยสภาพไม่อาจขอความยินยอมด้วยวิธีการดังกล่าวได้ ในการขอความยินยอมจากเจ้าของข้อมูลส่วนบุคคล ผู้ควบคุมข้อมูลส่วนบุคคลต้องแจ้ง วัตถุประสงค์ของการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลไปด้วย และการขอความยินยอมนั้น ต้องแยกส่วนออกจากข้อความอื่นอย่างชัดเจน มีแบบหรือข้อความที่เข้าถึงได้ง่ายและเข้าใจได้ รวมทั้ง ใช้ภาษาที่อ่านง่าย และไม่เป็นการหลอกลวงหรือทำให้เจ้าของข้อมูลส่วนบุคคลเข้าใจผิดในวัตถุประสงค์ ดังกล่าว ทั้งนี้ คณะกรรมการจะให้ผู้ควบคุมข้อมูลส่วนบุคคลขอความยินยอมจากเจ้าของข้อมูลส่วนบุคคล ตามแบบและข้อความที่คณะกรรมการประกาศกำหนดก็ได้ ในการขอความยินยอมจากเจ้าของข้อมูลส่วนบุคคล ผู้ควบคุมข้อมูลส่วนบุคคลต้องคำนึง อย่างถึงที่สุดในความเป็นอิสระของเจ้าของข้อมูลส่วนบุคคลในการให้ความยินยอม ทั้งนี้ ในการเข้าทำสัญญา ซึ่งรวมถึงการให้บริการใด ๆ ต้องไม่มีเงื่อนไขในการให้ความยินยอมเพื่อเก็บรวบรวม ใช้ หรือเปิดเผย ข้อมูลส่วนบุคคลที่ไม่มีความจำเป็นหรือเกี่ยวข้องสำหรับการเข้าทำสัญญาซึ่งรวมถึงการให้บริการนั้น ๆ เจ้าของข้อมูลส่วนบุคคลจะถอนความยินยอมเสียเมื่อใดก็ได้โดยจะต้องถอนความยินยอมได้ง่าย เช่นเดียวกับการให้ความยินยอม เว้นแต่มีข้อจำกัดสิทธิในการถอนความยินยอมโดยกฎหมายหรือ สัญญาที่ให้ประโยชน์แก่เจ้าของข้อมูลส่วนบุคคล ทั้งนี้ การถอนความยินยอมย่อมไม่ส่งผลกระทบต่อ การเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่เจ้าของข้อมูลส่วนบุคคลได้ให้ความยินยอมไปแล้ว โดยชอบตามที่กำหนดไว้ในหมวดนี้ ในกรณีที่การถอนความยินยอมส่งผลกระทบต่อเจ้าของข้อมูลส่วนบุคคลในเรื่องใด ผู้ควบคุม ข้อมูลส่วนบุคคลต้องแจ้งให้เจ้าของข้อมูลส่วนบุคคลทราบถึงผลกระทบจากการถอนความยินยอมนั้น การขอความยินยอมจากเจ้าของข้อมูลส่วนบุคคลที่ไม่เป็นไปตามที่กำหนดไว้ในหมวดนี้ ไม่มีผล ผูกพันเจ้าของข้อมูลส่วนบุคคล และไม่ทำให้ผู้ควบคุมข้อมูลส่วนบุคคลสามารถทำการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลได้

ในกรณีที่เจ้าของข้อมูลส่วนบุคคลเป็นผู้เยาว์ซึ่งยังไม่บรรลุนิติภาวะโดยการสมรส หรือไม่มีฐานะเสมือนดังบุคคลซึ่งบรรลุนิติภาวะแล้วตามมาตรา 27 แห่งประมวลกฎหมายแพ่งและพาณิชย์ การขอความยินยอมจากเจ้าของข้อมูลส่วนบุคคลดังกล่าว ให้ดำเนินการ ดังต่อไปนี้ (1) ในกรณีที่การให้ความยินยอมของผู้เยาว์ไม่ใช่การใด ๆ ซึ่งผู้เยาว์อาจให้ความยินยอม โดยลำพังได้ตามที่บัญญัติไว้ในมาตรา 22 มาตรา 23 หรือมาตรา 24 แห่งประมวลกฎหมายแพ่ง และพาณิชย์ ต้องได้รับความยินยอมจากผู้ใช้อำนาจปกครองที่มีอำนาจกระทำการแทนผู้เยาว์ด้วย (2) ในกรณีที่ผู้เยาว์มีอายุไม่เกินสิบปี ให้ขอความยินยอมจากผู้ใช้อำนาจปกครองที่มีอำนาจ กระทำการแทนผู้เยาว์ ในกรณีที่เจ้าของข้อมูลส่วนบุคคลเป็นคนไร้ความสามารถ การขอความยินยอมจากเจ้าของ ข้อมูลส่วนบุคคลดังกล่าว ให้ขอความยินยอมจากผู้อนุบาลที่มีอำนาจกระทำการแทนคนไร้ความสามารถ ในกรณีที่เจ้าของข้อมูลส่วนบุคคลเป็นคนเสมือนไร้ความสามารถ การขอความยินยอมจาก เจ้าของข้อมูลส่วนบุคคลดังกล่าว ให้ขอความยินยอมจากผู้พิทักษ์ที่มีอำนาจกระทำการแทนคนเสมือนไร้ ความสามารถ ให้นำความในวรรคหนึ่ง วรรคสอง และวรรคสาม มาใช้บังคับกับการถอนความยินยอมของ เจ้าของข้อมูลส่วนบุคคล การแจ้งให้เจ้าของข้อมูลส่วนบุคคลทราบ การใช้สิทธิของเจ้าของข้อมูล ส่วนบุคคล การร้องเรียนของเจ้าของข้อมูลส่วนบุคคล และการอื่นใดตามพระราชบัญญัตินี้ในกรณีที่ เจ้าของข้อมูลส่วนบุคคลเป็นผู้เยาว์ คนไร้ความสามารถ หรือคนเสมือนไร้ความสามารถ โดยอนุโลม

ตราสารใดไม่ปิดแสตมป์บริบูรณ์ จะใช้ต้นฉบับ คู่ฉบับ คู่ฉีก หรือสำเนาตราสารนั้นเป็นพยานหลักฐานในคดีแพ่งไม่ได้ จนกว่าจะได้เสียอากรโดยปิดแสตมป์ครบจำนวนตามอัตราในบัญชีท้ายหมวดนี้ และขีดฆ่าแล้ว แต่ทั้งนี้ ไม่เป็นการเสื่อมสิทธิที่จะเรียกเงินเพิ่มอากรตามมาตรา 113 และมาตรา 114
