Before paying

  • Check the chassis number and engine number on the Vehicle against the Registration Book, and check that the name of the owner in the book is the Seller. The book will show … as owner until the finance is settled. Obtain the finance company's written settlement figure (Clause 5.2) and pay that amount directly to the finance company, never in cash to the Seller.
  • A mechanic's inspection before signing is worth its cost. Anything the Buyer could have seen on a reasonable inspection is, as a rule, not the Seller's responsibility.
  • Pay by bank transfer to the Seller's own account (Clause 3.4) and keep the slips.

Transfer at the Department of Land Transport

  • Complete the transfer within … days after Completion (Clause 5.1). Thai law requires a change of owner to be notified to the registrar within a limited time, and fines may apply if it is late.
  • Each Party should bring the original ID card or passport. A foreign individual is normally asked for the passport and a certificate of residence issued by the Immigration Bureau or the embassy, or a valid work permit (Clause 5.3). Check the current list with the Land Transport Office before the appointment.
  • The Seller signs the transfer application and a power of attorney limited to this Vehicle. A power of attorney carries its own stamp duty. The Seller should ask for a copy of the Registration Book showing the Buyer's name after the transfer.Going together avoids problems with rejected forms and lets both Parties see the transfer recorded in the Registration Book.
  • The transfer fee and the stamp duty are paid by … (Clause 5.4). A receipt for the sale of a registered vehicle carries stamp duty of 1 THB for every 200 THB or part of 200 THB of the amount received, which by law falls on the person who issues the receipt; the Land Transport Office usually collects it with the transfer fee.

After handover

  • Fines and charges before handover are the Seller's, and after handover the Buyer's, even while the Registration Book still shows the Seller (Clause 6.1). Keep the signed Schedule 1 with the date, time and odometer reading.
  • The Buyer should arrange voluntary insurance from the day of handover. The Seller should cancel or transfer the Seller's policy (Clause 6.3).
  • The Seller should remove the Vehicle from any mobile application and cancel digital keys before handover (Clause 4.5).

Defects and disputes

  • The Vehicle is sold in its present condition, but the Seller remains liable for defects the Seller knew of and did not disclose (Clause 2.5).Report a defect covered by the warranty in writing within 7 days after discovering it (Clause 2.5). A claim for defects in goods sold must be brought within one year after the defect is discovered.
  • If the transfer is refused or the finance cannot be settled, the Buyer is entitled to a full refund within 7 days (Clause 7.3).
  • A court case about the Agreement is heard in Thai; a certified Thai translation of this Agreement will be needed. A foreign Party who plans to leave Thailand should finish the transfer, and settle any dispute, before leaving.
