When the Commission is earned
- Under Thai law, a broker earns commission only when the contract is actually concluded as a result of the broker's introduction, and if that contract is subject to a condition, only when the condition is fulfilled (Civil and Commercial Code section 845). Clause 5.2 follows this rule.
- The register of Introduced Customers decides most commission disputes. The Agent should register every Customer by email within 3 Business Days after the first introduction (Clause 3.3), and the Owner should keep those emails.
- This is an exclusive appointment. If the Owner sells or leases through another agent during the Term, the full Commission is still payable (Clause 5.4). If the Owner finds a Customer itself, …% of the Commission is payable. A court may reduce this amount if it is excessive compared with the Agent's actual work.- This is a non-exclusive appointment. Several agents may introduce the same Customer; the register and the dates of first introduction decide who earns the Commission.
- After the Term, the Commission is still payable for a Transaction with a registered Customer within … months (Clause 8.4).

บุคคลผู้ใดตกลงจะให้ค่าบำเหน็จแก่นายหน้าเพื่อที่ชี้ช่องให้ได้เข้าทำสัญญาก็ดี จัดการให้ได้ทำสัญญากันก็ดี ท่านว่าบุคคลผู้นั้นจะต้องรับผิดใช้ค่าบำเหน็จก็ต่อเมื่อสัญญานั้นได้ทำกันสำเร็จเนื่องแต่ผลแห่งการที่นายหน้าได้ชี้ช่องหรือจัดการนั้น ถ้าสัญญาที่ได้ทำกันไว้นั้นมีเงื่อนไขเป็นเงื่อนบังคับก่อนไซร้ ท่านว่าจะเรียกร้องบำเหน็จค่านายหน้ายังหาได้ไม่ จนกว่าเงื่อนไขนั้นสำเร็จแล้ว

ห้ามมิให้ผู้ควบคุมข้อมูลส่วนบุคคลใช้หรือเปิดเผยข้อมูลส่วนบุคคล โดยไม่ได้ รับความยินยอมจากเจ้าของข้อมูลส่วนบุคคล เว้นแต่เป็นข้อมูลส่วนบุคคลที่เก็บรวบรวมได้โดยได้รับยกเว้น ไม่ต้องขอความยินยอมตามมาตรา 24 หรือมาตรา 26 บุคคลหรือนิติบุคคลที่ได้รับข้อมูลส่วนบุคคลมาจากการเปิดเผยตามวรรคหนึ่ง จะต้องไม่ใช้หรือ เปิดเผยข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์อื่นนอกเหนือจากวัตถุประสงค์ที่ได้แจ้งไว้กับผู้ควบคุมข้อมูล ส่วนบุคคลในการขอรับข้อมูลส่วนบุคคลนั้น ในกรณีที่ผู้ควบคุมข้อมูลส่วนบุคคลใช้หรือเปิดเผยข้อมูลส่วนบุคคลที่ได้รับยกเว้นไม่ต้องขอ ความยินยอมตามวรรคหนึ่ง ผู้ควบคุมข้อมูลส่วนบุคคลต้องบันทึกการใช้หรือเปิดเผยนั้นไว้ในรายการ ตามมาตรา 39
