Key facts
Clauses in the template9
Stamp dutyIf the Model is paid for posing at the session, the Agreement is generally treated as a hire of work (Instrument 4 of the Stamp Duty Schedule): 1 THB for every 1,000 THB or part of 1,000 THB of the fee, paid by the Model. On the fee you entered, the duty on the original is the amount the system calculates from the figures entered, and each counterpart carries the amount the system calculates from the figures entered.Convert the fee to Thai Baht at the exchange rate on the date of signing to calculate the duty. A Thai company paying the fee to a model in Thailand normally withholds tax and issues a withholding tax certificate (Clause 4.2).- A release given without a fee is not an instrument listed in the Stamp Duty Schedule, so no stamp duty is normally payable.

Stamp duty

  • If the Model is paid for posing at the session, the Agreement is generally treated as a hire of work (Instrument 4 of the Stamp Duty Schedule): 1 THB for every 1,000 THB or part of 1,000 THB of the fee, paid by the Model. On the fee you entered, the duty on the original is the amount the system calculates from the figures entered, and each counterpart carries the amount the system calculates from the figures entered.Convert the fee to Thai Baht at the exchange rate on the date of signing to calculate the duty.
  • A Thai company paying the fee to a model in Thailand normally withholds tax and issues a withholding tax certificate (Clause 4.2).- A release given without a fee is not an instrument listed in the Stamp Duty Schedule, so no stamp duty is normally payable.

Before the session

  • Sign the release before the session, and give the Model a signed copy. A consent given afterwards is harder to prove and the Model may refuse.
  • Check the Model's identity document. Because the Model is under 20, the legal representative (usually a parent) must sign the consent block, and an adult must accompany the Model (Clause 6).- Check the Model's identity document. If the Model turns out to be under 20, do not use this version: tick the option for a Model under 20 so that the legal representative signs the consent block.
  • Tell the Model what the images are for. A vague purpose such as "any use" is risky under Thai personal data law; the Purpose you entered is the limit (Clause 2.1).

Using the images

  • Use the images only for: …, in …, in …, for … months.
  • You also need the photographer's permission (copyright licence) for each use. This release covers only the Model's rights (Clause 2.3).
  • Do not use AI to create new images, videos or voices of the Model, and do not use the images to train AI or face-recognition systems, without a separate written consent for that specific use (Clause 3.2).
  • Never publish the Model's address, telephone number or ID number, and do not tag the Model's personal accounts without consent (Clause 5.2).
  • When the Licence Period ends, stop new uses and paid promotion, and remove the images from your website within 30 days (Clause 5.3). Put the date in your calendar.

Keep the evidence

  • Keep the signed release, a copy of the Model's ID, and a record of where and when each image was used, for as long as you use the images and for a reasonable time after. Delete unused images within 12 months after the session (Clause 5.5).
  • A Thai court works in Thai, so English documents need a certified Thai translation in a dispute.
