Before the Moving Date
- Check that Schedule 1 lists all furniture, appliances and the number of boxes, and that every item worth more than … is in Part B with its value. An item that is not declared is compensated only up to that amount (Clause 7.5).
- Ask to see the Remover's licence to carry goods for reward by road and the insurance cover note (Clause 8.1).
- Book the service lift and parking with the building management at both addresses, defrost the fridge, drain the washing machine and back up your devices (Clause 4.1).
- Carry cash, jewellery, passports, title deeds, important documents and medicines yourself. Gas cylinders, fuel and other dangerous goods are not carried (Clause 3.2).
On the day
- Be present, or send a named adult, at loading and at unloading (Clause 4.2). Walk through the Inventory with the Crew leader and write existing damage and any added items in Schedule 2.
- At unloading, check the Goods before signing Schedule 2 and write down any damage you can see. Take dated photographs of valuable items at both ends.
- Pay the balance of the Price after unloading (Clause 6.2). If you dispute an extra charge, say so in writing; the Remover must still unload and may not keep your Goods once the Price is paid (Clause 6.4).
Damage and missing items
- Report damage that was not visible at unloading, and missing items, in writing within … days after the Delivery Date (Clause 7.3). Keep the damaged item and its packaging for 7 days for inspection.
- The Remover repairs, pays the repair cost or pays the market value within 30 days after the claim is agreed (Clause 7.4), up to the limits in Clause 7.5. The limits do not apply to theft, wilful acts or gross negligence (Clause 7.6).
- A claim against a carrier for loss or damage may be time-barred as soon as one year after delivery. Talking with the Remover does not stop that period, so do not wait if a claim is not settled (Clause 12.2).
Cancellation
- Cancel in writing at least … days before the Moving Date for a full refund. A later cancellation costs no more than …% of the Price (Clause 11.1). If the Remover cancels or fails to turn up, every amount paid is refunded within 7 days (Clause 11.3).
Stamp duty
- A removal agreement is treated as a hire of work for stamp duty: 1 THB for every 1,000 THB or part of 1,000 THB of the Price. On the Price you entered, the duty is the amount the system calculates from the figures entered, and a signed counterpart carries the amount the system calculates from the figures entered. By law the Remover pays it. An unstamped agreement cannot be used as evidence in a Thai civil court until the duty and a surcharge are paid.
Disputes
- A small claim can be brought in the Thai district (Kwaeng) court. The court works in Thai, so a certified Thai translation of this Agreement will be needed.
