Before installation

  • Get the load assessment signed or checked by a licensed electrical engineer before any Charger is ordered (Clause 3.1). If the transformer, main switchboard or meter must be upgraded, apply to the electricity utility early — upgrades can take months.
  • Obtain the written consent of the condominium juristic person, the building manager or the landlord before the Works start (Clause 4.1). A condominium usually needs a resolution of the owners' meeting to use common parking areas or common electrical systems.
  • Check whether the party that will charge EV Users for charging must obtain a licence, register or notify the Energy Regulatory Commission or any other authority under the rules in force at signing (Clause 4.3).
  • Tell your property insurer about the planned Chargers and ask whether it has any fire safety requirements (Clause 3.4).

Go-Live

  • Attend the tests, including a real charging session, and keep the commissioning report (Clause 6.3). If the Go-Live Date is late, reserve delay damages in writing on or before the Go-Live Date (Clause 6.5).
  • Check that the emergency stop, the instructions and the emergency number are fixed at every Charging Bay (Clause 11.1), and that no default password remains on any Charger (Clause 10.1).
  • Collect the as-built drawings, certifications, warranties and all credentials of the Chargers. You own the Chargers, so you must be able to move them to another platform (Clause 8.3).

Personal data and payments

  • You are the data controller of EV Users' personal data, and the Provider is your processor (Clause 9.1). Publish a privacy notice for EV Users in the app and at the Charging Bays, and check each monthly statement of collected payments against the platform reports (Clause 8.1).- The Provider is the data controller of EV Users' data and will give you only aggregated reports (Clause 9.1). Check each monthly statement of charging revenue, and use your right to audit if the figures look wrong (Clause 12.3).
  • If personal data is stored on cloud servers outside Thailand, ask which countries and what safeguards apply (Clause 9.2).

During the term and at the end

  • Report any damage, smell of burning, smoke or overheating within 24 hours and switch off the Charger if it looks dangerous (Clause 7.2).
  • If you sell the Site, tell the buyer that the Chargers belong to the Provider, and transfer this Agreement to the buyer (Clauses 5.3 and 20.3). At the end of the term, decide at least 60 days before the end date whether to buy the Chargers or have them removed (Clause 16.4).- When the Provider's maintenance or platform services end, make sure the Chargers are released to your new platform and you receive the session records (Clause 8.3).

Signing

  • A company signs through the director or directors named in its latest company affidavit, with the company seal if its rules require one. A condominium juristic person signs through its manager within the authority given by the owners' meeting or its regulations. Electronic signatures and signed PDF copies are valid (Clause 20.6).
