## Publishing these Terms on your store

- Put these Terms on a page of their own and link to it from every page footer and from the checkout. At checkout, show an unticked box such as "I have read and accept the Terms of Sale" next to a link to this page, and do not let the order go through until the box is ticked (Clause 1.3).
- Label the final checkout button so that it is clear that the customer is agreeing to pay, for example "Place order and pay". Show the total price, delivery charges, the import charges you have included and the delivery time in the summary before that button (Clause 4.1 and Clause 5.1).
- Send the Order Acknowledgement automatically, attach these Terms as a PDF or link to the exact version, and keep a record of which version each customer accepted and when. If you change the Terms, keep every old version with its effective date (Clause 15.1).

## Registrations before you sell

- A business that sells to consumers online in Thailand is generally treated as a direct marketing business and must register with the Office of the Consumer Protection Board before it starts selling. Online sellers also generally need a commercial registration with the Department of Business Development or the local authority, and should show it on the website. Check your own position before launch.
- Many products need a Thai licence or registration before they can be made, sold or exported, for example food, cosmetics, drugs, supplements, medical devices and products under mandatory Thai industrial standards. The destination country may have its own rules and labelling requirements.

## Consumer rights you cannot contract out of

- Selling to consumers at a distance is covered by consumer protection law in Thailand and in most destination countries. Thai law gives buyers from a direct marketing business a right to return goods within at least 7 days after receiving them. The European Union and the United Kingdom give 14 days and require specific information before the order. You set … days in Clause 8.1.
- Consumer law in the customer's country can apply even though these Terms choose Thai law, if you direct your store at customers in that country, for example by selling in their currency, shipping there or advertising there. Clause 12.3 and Clause 12.4 do not remove those rights, and a clause that tried to do so would not be enforced.
- Refund a consumer who cancels within 14 days after receiving the cancellation notice (Clause 8.4). Thai direct marketing rules count the refund period from the notice, not from the return of the goods, so do not wait for the parcel to come back before refunding.
- You offer a store warranty (Clause 9.6). Thai consumer law requires a warranty given to a consumer to be a written document signed by the business, delivered with the goods, and, if it is in a foreign language, accompanied by a Thai translation. Prepare a short warranty card in Thai and English and include it in parcels to Thai addresses.
- Do not add "no refunds", "no returns without an unboxing video" or "all sales final" to product pages. Such statements conflict with Clause 8 and Clause 9 and are likely to be unfair to consumers under the Unfair Contract Terms Act B.E. 2540 (1997).

- Get a separate, unticked consent for marketing emails (Clause 11.3). Customers in the European Union or the United Kingdom may also be protected by the GDPR if you target them.
- If a data breach happens, you must generally notify the Personal Data Protection Committee within 72 hours after becoming aware of it (section 37(4)).
