## Before the first Visit

- Check that Schedule 1 lists every room and task, the number of Cleaners and the minimum hours. Anything not listed is not included (Clauses 2.3 and 2.4).
- Put away cash, jewellery, watches, documents and small devices before every Visit, and list fragile items and special surfaces in Schedule 1 (Clause 5.2).
- If a camera in the Home can record the Cleaners, tell the Provider in writing which areas it covers. Never record a bathroom or a place where a Cleaner may change (Clause 5.3).
- Record every key, key card and access code in the table in Schedule 1 and have the Provider sign for it. Do not write real passwords in this Agreement; give them separately, and change the codes when this Agreement ends (Clauses 4.1 to 4.3).

## The Cleaners

- The Cleaners are the Provider's employees. Give instructions through the Provider, and do not pay wages to the Cleaners directly or ask them to do work outside this Agreement; otherwise you risk being treated as their employer (Clause 3.3).
- Ask the Provider to confirm the name of each Cleaner before the first Visit, and that any foreign Cleaner holds a valid work permit (Clauses 3.1 and 3.2).

## Damage, missing items and poor cleaning

- Report damage, missing items or poorly cleaned areas in writing with photographs within 2 days after the Visit (Clause 6.3). The Provider re-cleans within 3 days or refunds that part of the Fee, and repairs or pays for damage within 14 days after it is confirmed (Clause 6.4).
- Compensation is limited as stated in Clause 10.1, but the limit does not apply to theft, wilful acts, gross negligence or personal injury (Clause 10.2).

## Money

- Pay by bank transfer or PromptPay to the Provider's account and keep the receipts (Clause 7.2). A Provider registered for VAT must give a tax invoice.
- Cancel or reschedule at least … hours before a Visit to avoid a charge. A late cancellation costs at most …% of that Visit's Fee (Clause 8.1), and anything paid in advance for a Visit that does not take place is refunded within 7 days (Clause 8.3).

## Stamp duty

- A cleaning services agreement is treated as a hire of work for stamp duty: **1 THB for every 1,000 THB or part of 1,000 THB** of the total Fees. On the total you entered, the duty is the amount the system calculates from the figures entered, and a signed counterpart carries the amount the system calculates from the figures entered. By law the Provider pays it. An unstamped agreement cannot be used as evidence in a Thai civil court until the duty and a surcharge are paid.

## Disputes

- Try to settle a complaint by discussion first (Clause 13.2). A small claim can be brought in the Thai district (Kwaeng) court for the area of the Home. The court works in Thai, so a certified Thai translation of this Agreement will be needed.
